Breaking News! Joint Export Control Decision Issued by MOFCOM and GAC, Covering Lithium Batteries and Artificial Graphite Anode Materials

On October 9, 2025, the Ministry of Commerce of the People's Republic of China (MOFCOM) and the General Administration of Customs of the People's Republic of China (GAC) jointly issued Announcement No. 58, announcing the implementation of export controls on lithium batteries, artificial graphite anode materials and related items. Approved by the State Council, this decision aims to safeguard national security and interests and fulfill international obligations such as non-proliferation.


This Announcement shall come into force on November 8, 2025, and the Catalogue of Dual-Use Items Subject to Export Control of the People's Republic of China shall be updated simultaneously.


1. Scope of Controlled Items

<1> Lithium Battery-Related Items

3A001: Rechargeable lithium-ion batteries (including cells and battery packs) with a gravimetric energy density ≥ 300 Wh/kg (Refer to tariff code: 85076000);

3B901.a: Equipment for manufacturing rechargeable lithium-ion batteries: Winding machines (Refer to tariff code: 84798999), laminating machines (Refer to tariff code: 84798999), electrolyte injection machines (Refer to tariff code: 84798999), hot presses, formation and grading systems, grading cabinets;

3E901.a: Technologies for producing the controlled items specified in 3A001.


<2> Cathode Material-Related Items

3C901.a.1: Lithium iron phosphate cathode materials with a tap density ≥ 2.5g/cm³ and a specific capacity ≥ 156mAh/g (Refer to tariff code: 28429040);

3C901.a.2: Precursor-related items for ternary cathode materials: Nickel-cobalt-manganese hydroxide (Refer to tariff code: 28539030), nickel-cobalt-aluminum hydroxide (Refer to tariff code: 28539050);

3C901.a.3: Lithium-rich manganese-based cathode materials;

3B901.b: Equipment for manufacturing cathode materials: Roller kilns, high-speed mixers, sand mills, jet mills.


<3> Graphite Anode Material-Related Items

3C901.b.1: Artificial graphite anode materials;

3C901.b.2: Anode materials mixed with artificial graphite and natural graphite;

3B901.c.1: Granulation equipment for producing graphite anode materials: Vertical granulation kettles with a granulation volume ≥ 5m³; Continuous granulation kettles with a granulation volume ≥ 5m³;

3B901.c.2: Graphitization equipment for producing graphite anode materials: Box furnaces, Acheson furnaces, internal series furnaces, continuous graphitization furnaces;

3B901.c.3: Coating modification equipment for producing graphite anode materials: Fusion coating equipment with a volume > 300L; Spray drying equipment with a volume > 60m³; Chemical Vapor Deposition (CVD) rotary kilns with a barrel diameter > 0.5m;

3E901.b: Processes and technologies for producing graphite anode materials: Granulation process, continuous graphitization technology, liquid-phase coating technology.


2. Export Requirements

<1> License Application

Export operators shall apply for licenses from the competent commerce department of the State Council and complete the formalities in accordance with the relevant provisions of the Export Control Law of the People's Republic of China and the Regulations of the People's Republic of China on the Export Control of Dual-Use Items.


<2> Truthful Declaration

Export operators shall be responsible for the authenticity of the declared goods and strengthen the identification of exported items.


<3> Remark Requirements

For items subject to control: Must be marked with "Belongs to dual-use items" and the corresponding code listed;


For items not subject to control but with parameters, indicators or performance close to controlled standards: Must be marked with "Does not belong to dual-use items" and specific parameters/indicators provided.


If there is any doubt about the completeness, accuracy or authenticity of the declared information, the customs shall raise objections in accordance with the law, and the exported goods shall not be released during the objection period.


3. Implementation Time

This Announcement shall officially come into force on November 8, 2025. The Catalogue of Dual-Use Items Subject to Export Control of the People's Republic of China shall be updated simultaneously.
