In June 2025, during an on-site inspection of a local electronics company, the Quanzhou Radio Administration Bureau discovered that the radio walkie-talkies it sold had not obtained type approval.

This act violated Article 48 of the "Radio Administration Regulations of the People's Republic of China." In accordance with Article 78 of the same regulations and the provisions of Category 1, Serial Number 10 in "Table II of the Fujian Provincial Department of Industry and Information Technology's Administrative Penalty Discretion Benchmark," the law enforcement department imposed an administrative penalty on the company, confiscating the illegal equipment and illegal gains.

Legal Basis and Penalty Standards

Article 44 of the "Radio Administration Regulations of the People's Republic of China"

Except for micro-power short-range radio transmission equipment, other radio transmission equipment produced or imported for domestic sale or use shall apply to the national radio administration authority for type approval. The radio transmission equipment type approval catalog is published by the national radio administration authority.

Radio transmission equipment that should obtain type approval for production or import shall, in addition to complying with Article 43 of these regulations, also comply with the technical indicators specified in the radio transmission equipment type approval certificate and shall be marked with the type approval code on the equipment.


Article 48 of the "Radio Administration Regulations of the People's Republic of China"

Selling radio transmission equipment that should obtain type approval according to Article 44 of these regulations shall be registered with the radio administration authorities of provinces, autonomous regions, or municipalities directly under the central government. It is prohibited to sell radio transmission equipment that is not marked with the type approval code as required by these regulations.

Article 78 of the "Radio Administration Regulations of the People's Republic of China"

Selling radio transmission equipment that should obtain type approval according to Article 44 of these regulations but has not obtained such approval shall be ordered by the radio administration authority to make corrections, with confiscation of the illegally sold radio transmission equipment and illegal gains, and may also be fined up to 10% of the value of the illegally sold equipment; if corrections are refused, a fine of 10% to 30% of the value of the illegally sold equipment shall be imposed.
